VA, CRSC, and Retirement

All,

Hello.  I'm not new to the forum, I've been a long time lurker, just registered because I'm now just lost in the sauce.  I literally JUST walked out of a benefits brief, and I think the entire class was given some bogus information.  I'm also being told that what I've read here is wrong (every time I raised my hand to question what was being briefed).

Background Information:  I am currently undergoing a medboard, and by the time that's over with I'll have 6 years of active service in the Army (had 5 years in the Marine reserves).  I have been diagnosed with chronic PTSD (among other things that I won't mention here just for simplicity's sake), and am told I can expect an automatic 50% disability rating from the DoD.  I am also told that normally this will end with me being medically retired.

THIS is what I got out of the brief today (very contrary to what I have...

Phone conversation with DFAS today, My Retro Pay will be $8,877.00 payable within 30-60 days. Nice chunk of change. DFAS audit only took 34 days.  One check from DFAS for $435.00 and remaining $8424.00 of retro will be issued from the VA. As we all know 30-60 days for the VA to respond is usually 90-180 days, lol. but hey! it will be here sometime.

CRSC retro - ex-spouse repays??

I was awarded 50% CRSC starting August 2010. My new pay started this past Oct. and my ex getting her reduced left over percentage of my balance of retired pay as well. I was told this morning by DFAS that I wouldn't get any retro pay until my ex repays her overpaid amount. There is no way my ex can or will pay DFAS any over paid amount that she received back to August 2010. Does this mean I get NO retro pay for CRSC? I thought DFAS would pay me retro and “bill” her for the same amount. I'm confused. It seems I'm out over $16,000.

Would CRSC apply to me

I just retired from the Navy after 20 years of active service and I'm getting retired pay.

I also just go my first letter from the VA rating me at 90% total.

50% rating is for PTSD that was cause during combat.  I might be able to argue that a couple of my 10%s were caused during combat or combat training.

Will CRSC apply to me..is that something I should apply for.  My understanding is that because of my level I will get "concurrent receipt"...so that I will get all my retired pay (taxable) and all my va disability for 90% (non taxable).  Is this correct??

So if I apply and "win" CRSC...is that an additional payment...or does it make some of my retired pay non-taxable??

I obviously don't have a handle on what CRSC does or is...hoping someone can guide me in my...

Help with CRSC estimation

I am new to the forum, but have been researching extensively the past few months. I have anticipated a medical discharge and the word has finally come down. 21 Dec this year I will be let go. I am trying to determine what my CRSC payment will be if any at all. Looking for some help as I am not sure of the info I have been using in the calculators online. I am a E4 in the National Guard. I have held my rank for 2 years 5 months. I deployed to Afghanistan and was on orders for almost 13 months. I have 4 years 5 months in service. The VA has given me an 80% disability rating. One disability at 60% and three others each at 10%. All 4 disabilities are all combat related. If somebody could help me either with the answer amount or how to use the high 3 or National Guard retirement estimator so that i can finish my calculations it would be much appreciated. My next drill I am trying to be best informed as i can to help the others in my same boat and so that I dont get bent over by the Army...

How long does it take DFAS to compute crsc retyo/back pay

I would like to know how long it takes DFAS to compute back pay. I received my letter from the DOA approximately Oct. 10 that stated I was awarded CRSC with a start date of Jan 2008. I began receiving my CRSC payments on Nov 1 of $617. I keep getting the runaround from DFAS. I was told that it came out of audit on Nov 27, but quality control rejected it because of an error. Has anyone dealt with this issue? When can I expect the back pay?

Army Rating 40%
VA Rating 90%
TIS: 12yrs 4 months

Retirement: $1078 (I'm not receiving)
DVA Comp: $2040
CRSC: $617

I don't understand the formula/math that they use to come up with the CRSC amount. Can anyone help?

100% P&T, should I apply for CRSC?

I'm a regular 20 year retiree and was just awarded 100% P&T yesterday.  I've read the stickys and FAQs about CRSC but I'm still a bit confused.

Q:  Is CRSC in addition to my regular military retirement (high 3) and VA disability?

Q:  My combat related injuries are TBI, PTSD, and knee injury these add up to roughly 70%, any idea what (ballpark) that would amount to?

I'm trying to see if it's beneficial to go down this road or just stick with my military retirement.  I wasn't awarded a Purple Heart for the TBI because it wasn't discovered until a couple of years after when I started having memory and cognative issues.  I was injured in a blast during the invasion in OIF I.  I wasn't knocked unconcious but got rattled pretty good and my knee was smashed up.  I just "pressed on".  Later it was suggested by my doc that I pursue a PH but I knew/know too many guys that died or lost limbs so I never pursued...

Got my letter from Navy CRSC board yesterday.  Approved for 30 %, got 20 % for diabetes and 10% for Tinnitus (which I wasen't expecting because I did not even put in for the Tinnitus which was VA rated since 2003, did not think I could prove combat related). Also got SMC-K.  Anyway I am a  W-4 30+ year retiree.  What should I expect monthly?  Navy said I should get back pay to Dec 2006 for Tinnitus and April 2011 for diabetes.  The letter with approval was less than one month.

TDIU for CRSC only?

I am 100% T&P.  Currently have a 40% disability for diabetes type 2 which qualifies for CRSC, for which I get the whopping sum of $210/mo.  Have an appeal working which will link some other issues as secondary to diabetes which should increase my CRSC, but may not get the CRSC rating up to the magic 95%.  Does anyone have any experience getting a TDIU 100% rating just for CRSC?  If so I welcome suggestions since TDIU is usually not granted to someone with a 100% T&P rating.

DoD disability pay calculation

Hi  everyone,
I'm still waiting for my CRSC decision from DoD. Email said paper received 11/20/12, takes 45 days.
I've been posting comments regarding to "expected amount" for my CRSC pay. Answer from Dally was $141 CRSC
Now, from Mr. Parker's 6 steps formula. I got every amount BUT the DoD disability pay.
Tried to search online for the formula but still didn't get through. So here's my breakdown
1.Army 30% permanent disabled (chapter 61)
2. VA disability total 80% ($1,478/month)
3. YOS (3 years, 4 months, E4-06/11/04-09/27/07) disability pay before VA waiver is $516/month
My high 3 broke down as followed and by using Mr. Parker's Excel worksheet
E4-June07-June06: $1,883/month
E3-June06-June05: $1,630/month
E2-June05-June04: $1458/month
----------------------------------------
Multiply each by 12 and add together I have high 3 = $1,669
How would...

Service Connection Increased, CRSC Compensation Decreased??

Previously, I was VA disability service connected at 90%, IU, and 80% CRSC. Recently, a VA decision raised my VA disability to 100% service connected, IU continued, and now added P&T. I went up to MyPay to check my CRSC statement and found that my CRSC pay had dropped down to 80% of my retired pay. Previously, I had been paid at the 100% due to the IU as per Title 38 CFR 4.16.

I contacted DFAS and a CS support rep said that when you become 100% service connected, DFAS no longer pays CRSC at the 100% even if you have IU. She couldn't explain why and my CRSC statement continues to reflect "YES" next to the "UNEMPLOYABLE" field.

I have searched through Title 38 and various amendments through the years but cannot find anything which supports what the CS rep told me. The Rep submitted a message to the CRSC people and told me that I would get a reply in 10 business days but I'm not holding my breath. Can anyone...

I have been browsing VBN for a few weeks now trying to solve a few questions with out someone repeating the same information they may have already been posted before.  I too, like others I have noticed on VBN, am a member of the SABO lawsuit.  My rating was changed to 100% from the lawsuit and my orders from the Army are in the process of being changed to reflect.  I have been receiving VA benefits since 2008 and was also rated at 100% from the VA and currently receive their max pay which I do believe is $2769.  I recently received a letter from my SABO intake specialist saying that I have been determined to qualify for CRSC and I have in returned contacted them to fill out the proper paper work.

Now on to my question, I have seen numerous numbers and calculations for other vets calculating their amounts and I too, am trying to figure out what I would receive if anything.
I was medically discharged on September 2007 after 5 years and...

Hi guys,
Just a little update on my end. I've received the CRSC letter saying that I'm approved 80% for combat related injuries. Now I'm just awaiting DFAS to do the pay/calculation.
Like posted in other thread, due to the 3 year and 4 months of YOS. I'd probably get an extra $140/month on top of my 80% VA.
Thanks for the moderators for being so patiently answering my questions, again.
Cheers!
P.S: For members, Chapter 61 (under 15years) retirees who are still wondering on the how-to turn the paperwork for CRSC. These are the items you'll need to have the CRSC approved the first time try (All copies, keep your originals). Yes, you must be combat related to be able to apply for CRSC, Purple Heart is a guarantee of proof
1. Form DD2860
2. Your DD214
3. Your retirement order **this should be in the packet they handed to you before you're cleared out
4. Your combat/Medivac report-this should have the...

Confused about determining basic pay

$

I have a question regarding the term “base pay” used in retirement calculations.  I began active duty June 1974 and left active duty as an officer in 1982. Years later, I enlisted in the National Guard, served in OIF and retired with DFAS disability as a SSG (E6) in Dec 2012. Will my base pay be based on 1982 pay charts when I was at my highest rank (O3), or will they be based on 2012 pay charts, when I was at a lower rank, E6? I don’t know whether DFAS should (1) use the 1982 or 2012 pay chart and (2) use my rank as Captain or Staff Sergeant  to determine base p ay.

Finally received CRSC rating

Background..Hubby retired after 21 years. VA rating 90%.  Receiving CRDP.  Filed for CRSC back in September, received letter on Saturday saying that he received 60% rating for Combat Related.

My question is now that we know this rating, I am assuming that he will receive the following:

Retired pay 40% taxed
CRSC 60% tax free
VA 90% tax free

1. Since he has been receiveing CRDP will DFAS revise his 1099R for 2012 (already on mypay)?
2. Will they automatically switch him to CRSC, I know they usually detirmine which is better for the service member between CRDP and CRSC, but since the dollar amount won't change (assumption on my part) but the tax benefit would be better for us to take CRSC?
3. Am I correct in the fact that I can now go back and revise out taxes for 2011?  Effective date per letter is Sept 2011.

Thank you so much in advance for your help.
